1. The Agreement
These Terms of Service govern your use of Skill Data's services and website. By starting a free trial, purchasing a plan, or continuing to use the services, you agree to these terms. "Skill Data," "we," and "us" refer to Skill Data Agency; "you" refers to the business subscribing to a plan.
2. The Service
Skill Data provides content strategy, filming, editing, publishing, and related marketing services for home service businesses, delivered according to the plan you select (Starter, Builder, or Leader). Plan inclusions are described on the Plans page at the time you subscribe. Leader is available by invitation only.
3. Free Trial
Every plan begins with a 14-day free trial. You receive the full service during the trial. The one-time setup fee is charged when the trial begins; no monthly fee is charged during the trial. You may cancel at any time before the trial ends — the setup fee is then refunded in full and you owe nothing. If you do not cancel, your monthly subscription is charged when the trial converts to a paid plan on day 15.
4. Fees and Billing
Plans are billed monthly, in advance: Starter at $2,500 per month and Builder at $7,500 per month. Leader pricing is set by invitation. All prices are in Canadian dollars and are subject to HST.
Monthly fees are earned when paid and are non-refundable once a billing month has begun, except where a guarantee in section 6 applies. We may change plan pricing with at least 30 days' written notice; changes take effect at your next billing cycle.
5. Setup Fee
A one-time setup fee equal to 1.5× your monthly plan price ($3,750 on Starter; $11,250 on Builder) is charged once, when your trial begins. It covers onboarding, strategy, brand setup, and channel builds. The setup fee is refunded in full if you cancel before your trial ends (section 3), or if we fail the 30-Day Live Guarantee and you choose to end the agreement rather than have us keep working at no charge.
6. Guarantees
30-Day Live Guarantee (all plans). Your content will be live within 30 days of the start of your paid plan. If it is not, we continue working at no charge until it is, or you may end the agreement under section 5.
90-Day Inbound Guarantee (Builder and up). If you do not receive tracked inbound leads within the first 90 days of your paid plan, you receive the next 90 days of service at no charge. "Tracked inbound leads" means calls, form submissions, and direct messages attributed through the reporting we share with you. Guarantees are conditional on your reasonable cooperation, including making filming days available as scheduled.
7. Territory Lock
While you are an active Builder client, we will not provide services to another contractor in your trade within your agreed zone. On Leader, this exclusivity extends to your agreed region. The zone or region is defined in writing at onboarding. Exclusivity lasts only while your subscription is active and ends when your subscription ends. Skill Data currently serves clients in Ontario, Canada only.
8. Your Responsibilities
You agree to make yourself or a designated team member available for scheduled filming, provide accurate information about your business and licensing, hold the permits and insurance required for your trade, and grant us the account access needed to publish on your behalf. Delays caused by missed filming days or withheld access pause the guarantee clocks in section 6.
9. Content and Ownership
Finished content we produce for you is yours to use for your business, on any channel, indefinitely — including after you leave. We retain the right to reference the work in our own portfolio and marketing unless you ask us in writing not to. Raw footage remains ours; we keep it available for at least 12 months after your subscription ends.
10. Cancellation
You may cancel at any time by written notice (email is fine). Cancellation takes effect at the end of the current billing month; you keep the full service until then. There is no cancellation fee. On cancellation, your zone exclusivity ends and your zone becomes available to other contractors.
11. Refunds
Except as stated in sections 3, 5 and 6, fees already paid are non-refundable.
12. Limitation of Liability
Marketing results depend on factors outside any agency's control. Beyond the guarantees in section 6, we do not promise specific revenue, rankings, or lead volumes. To the maximum extent permitted by law, our total liability under this agreement is limited to the fees you paid to us in the three months preceding the claim, and neither party is liable for indirect or consequential damages.
13. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute will be resolved in the courts of Ontario.
14. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated by email at least 30 days before they take effect. Continuing to use the services after that date means you accept the updated terms.
