and the content services we provide ("Services"). By using our website, signing up for a free trial, or purchasing a plan,
you agree to these Terms. If you do not agree, please do not use our Services.

In these Terms, "we", "us", and "our" mean Skill Data. "You" and "your" mean the person or business using our Services.

Our Services

We are a content agency for home-service and local businesses. Our Services include coaching you through filming, editing your footage into short-form and long-form videos, writing captions, creating thumbnails, posting content to your social media platforms, and providing performance reporting and strategy support. The exact deliverables depend on the plan you choose, as described on our Plans page.

We may improve, change, or discontinue parts of the Services at any time. If a change materially reduces what your plan includes, we will let you know.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to use our Services. By using the Services, you confirm that the information you give us is accurate and that you are authorized to act for the business you represent.

Accounts and Access

To deliver the Services, you may need to give us access to your social media accounts or create new ones with us. You are responsible for keeping your login details secure and for the activity on your accounts. You agree to give us the access, materials, and cooperation we reasonably need to perform the Services, including showing up for scheduled filming sessions.

Free Trial

We may offer a free trial. The trial lets you experience the Services before committing.

Unless you cancel before the trial ends, your plan will automatically begin and you will be billed on the schedule described in Section 5 / state your actual conversion terms. You can cancel during the trial as described in Section 7.

Fees, Billing, and Payment

Current pricing for each plan is shown on our Plans page. Our plans are billed on a recurring [bi-weekly] subscription basis, and a one-time setup fee applies when you start. By purchasing a plan, you authorize us (or our payment processor) to charge your payment method on each billing date until you cancel.

Fees are stated in USD currency, and are exclusive of applicable taxes. If a payment fails, we may pause the Services. You are responsible for keeping your payment information current.

We may change our pricing from time to time. Any price change will not affect the current billing cycle and we will give you notice before it takes effect.

Money-Back Guarantee

We offer a 30-day money-back guarantee only on setup fees per your plan. Setup fee are refunded within 3-14 days after cancelation. This guarantee is in addition to any rights you may have under applicable consumer-protection law.

Cancellation and Termination

You may cancel your plan at any time by Contacting us via "skilldata.net/contact-us". Your full plan will be completely cancelled at the end of your billing cycle.

We may suspend or end your access to the Services if you breach these Terms, fail to pay, or misuse the Services. On termination, any fees owed up to the termination date remain payable.

Your Responsibilities

To get the most from the Services, you agree to:

Take part in scheduled filming sessions and provide the time and information we need.

Make sure you have the rights to any locations, people, products, logos, or materials shown in your content.

Respond to requests for approval or feedback in a reasonable time.

Use the content and Services lawfully and not for anything misleading, harmful, or in breach of any third-party platform's rules.

Delays caused by missed sessions, late approvals, or missing materials may affect delivery timelines.

Content Ownership and Use

Once we have delivered the final content to you and your account is in good standing, you own the final delivered content and may use it for your business. We retain ownership of our underlying tools, templates, processes, and any work product not delivered to you.

You grant us a non-exclusive license to use the content we create for you, and your business name and logo, in our portfolio, case studies, and marketing, unless you ask us in writing not to.

Third-Party Platforms

Our Services involve third-party platforms such as Instagram, Facebook, TikTok, and YouTube. Your use of those platforms is subject to their own terms, and we are not responsible for their actions, outages, policy changes, or decisions to remove content or accounts. We do not control these platforms and cannot guarantee their availability.

No Guarantee of Results

We work hard to create high-quality content, but we cannot and do not guarantee specific results, such as a particular number of views, followers, leads, or sales. Results depend on many factors outside our control, including your market, your participation, and how the platforms operate.

Intellectual Property

All content on our website — including our name, logo, text, graphics, and design — is owned by us or our licensors and is protected by intellectual-property laws. You may not copy, reproduce, or reuse it without our permission, except for content we have delivered to you under Section 9.

Confidentiality

Each party agrees to keep the other party's non-public business information confidential and to use it only to perform or receive the Services.

Disclaimers and Limitation of Liability

The Services and website are provided "as is" and "as available," without warranties of any kind except those that cannot be excluded by law.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the one months before the claim arose. Nothing in these Terms limits any rights you have under applicable consumer-protection law.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or costs arising from your breach of these Terms, your content, or your use of the Services, including claims that your content infringes someone else's rights.

Privacy

Your use of the Services is also governed by our Privacy Policy and Policies page, which explains how we handle your information.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. If the changes are significant, we will give you reasonable notice. Continuing to use the Services after changes take effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You agree that any dispute will be handled in the courts located in Canada, unless applicable law requires otherwise.

General

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us about the Services and replace any earlier agreements on the same subject.
